Board of Education of Topeka is significant because, it was the successful overturn of the Plessey Doctrine (Plessey v. Ferguson) ruling which ruled that “separate but equal” facilities did not violate the Constitution. Prior to this ruling, any state had the ability to require black students to attend separate schools from whites with equal public school (which they were not). “The Court ruled that such segregation did not violate the Fourteenth Amendment as long as blacks had access to accommodations equal to those of whites” (Henretta, 2012). “The Supreme Court’s decision in the Brown case decision on the Brown v. Board of Education did not abolish segregation in other public areas, such as restaurants and restrooms, nor did it require desegregation of public schools by a specific time. It did, however, declare the permissive or mandatory segregation that existed in 21 states unconstitutional” (Cozzens, 1998)
