Since the agency started back in 1930 there have been numerous amounts of laws affecting this agency and the way they respond to our veterans. The case of Rose v. Rose, 481 U.S. 619 (1987), ensured that our veterans and their families received proper care. From this point on veterans could now make sure their families were properly taken care of without worrying about how much money they didn’t have. Secondly, the New GI Bill offered to those who entered the military was a major law affecting this agency. This new bill was authorized by Senator Jim Webb of Virginia. The benefits increased from about 40,000 a year to about 90,000. This also allowed veterans attending public universities to be covered fully by scholarships while they are in school. Lastly, there is the Defense of Marriage Act which came into play in 2013. According to The Department of Veteran Affairs, this act limited the terms “marriage” and “spouse” for purposes of Federal statutes, regulations, or rulings, to only include persons of the opposite sex, is unconstitutional. On September 4, 2013, the Attorney General informed Congress that the President has directed the Executive Branch to cease enforcement of similar provisions in sections 101(3) and 101(31) of Title 38 of the United States Code to the extent those provisions preclude recognition of legally valid marriages of same-sex couples. (The Department of Veteran Affairs, 2014). With DOMA in place individuals who are in same sex marriages could not reap the benefits are a surviving spouse or their children. However, this has all changes as the VA no longer denies benefits for those in same sex marriages. 2 | P a g e
