There four philosophical reasons for sentencing criminals are retribution, deterrence, incapacitation and rehabilitation. The act of taking revenge on a criminal perpetrator, retribution is the philosophy that the punishment should be decided by the severity of the crime committed, this philosophy is mostly inspired by the Old Testament and the known statement of “an eye for an eye and a tooth for a tooth”, this reasoning is not as popular as it once was in the criminal justice system; since other forms of sentencing and punishment have been established. The deterrence philosophy has two parts to it, the general and specific deterrence. This is based on an assumption that a criminal may come to realize that the punishment for the crime they contemplate on committing outweighs the crime. This is mainly based on the hope that a potential criminal may come to their senses and will not follow through with the crime whereby preventing a criminal act. So, the general deterrence works by way that if the punishment is known and has been seen to outweigh the crime, others will refrain from committing the same or similar acts crime.
